October Three is dedicated to developing retirement programs
that better fit the needs of companies and their employees. This
solution based approach has a positive and forward looking
orientation. But we also must be realistic. Employers will not be
receptive to new and innovative solutions while there are major
environmental impediments. The regulatory environment has
been one such impediment - and October Three is actively
pursuing initiatives to provide more clarity and enable innovation.

Addressing Litigation Risk

Our Dispute Resolution Practice addresses another of those impediments: the proliferation of opportunistic lawsuits against defined benefit plans, especially innovative designs like cash balance plans. Litigation risk has become a major element in pushing employers –not just those directly attacked – out of the DB system.

Extensive Experience

Our consultants are available to work with employers and their legal counsel to provide advice, financial analysis as well as expert testimony in lawsuits involving defined benefit plans. We also help employers in disputes or potential disputes outside of litigation. This includes involvement in arbitration and mediation.

Many other actuarial and employee benefit firms are unwilling or unable to effectively take on these kinds of projects. We view this work as important and our consultants have considerable experience in these matters.
